General Terms and Conditions

§ 1 Scope and Contracting Partner

(1) These General Terms and Conditions apply to all orders placed by consumers (according to § 13 of the German Civil Code (BGB)) via the online shop at www.niesmann-bischoff.ci-artwork.de, operated by Ci ArtWork GmbH & Co. KG, Zum Bergfried 1, 56841 Traben-Trarbach, Managing Director: Martin Modler, Wittlich District Court, Commercial Register No. 20784.

 

(2) A consumer is any natural person who concludes a legal transaction for a purpose that cannot be attributed to their commercial or independent professional activity.

 

(3) The contractual language is German.

 

(4) Our offer is aimed exclusively at adults. By entering your date of birth during the ordering process, you confirm that you are at least 18 years old.

 

(5) You can reach our customer service Monday to Friday (excluding public holidays) from 8:00 a.m. to 5:00 p.m. by phone at +49 6541 818966-0 (regular landline rate) or by email at info@ci-artwork.de.

 

§ 2 Conclusion of Contract

(1) By clicking the "Order with payment" button, you place a binding order for the goods listed on the order page. You will receive the order confirmation by email immediately after submitting your order. This concludes the purchase contract.

 

(2) Should our order confirmation contain typographical or printing errors, or should our pricing be based on technical transmission errors, we reserve the right to contest the order, in which case we must prove our error to you. Any payments already made will be refunded immediately.

 

§ 3 Prices

The prices listed on the product pages include statutory VAT and other price components and are exclusive of shipping costs.

 

§ 4 Shipping Costs

For deliveries within Germany, we charge shipping costs based on weight, as stated on the Shipping Conditions page.

 

§ 5 Delivery Conditions and Reservation of Self-Delivery

(1) Delivery is only within Germany. The shipping service provider is DHL.

 

(2) The delivery time for in-stock items within Germany is approximately 5 days, unless otherwise stated in the offer.

 

(3) If not all ordered products are in stock, we are entitled to make partial deliveries at our own expense, provided this is reasonable for you.

 

(4) If delivery of the goods fails due to your fault (e.g., because the courier did not find anyone at the delivery address and the shipment was not picked up within the storage period), we may withdraw from the contract. Any payments made will be refunded immediately, less a processing fee of €9.00.

 

(5) If the ordered product is not available because we are not supplied with this product by our suppliers through no fault of our own, we may withdraw from the contract. In this case, we will inform you immediately and, if necessary, propose delivery of a comparable product. If no comparable product is available or you do not wish to receive a comparable product, we will promptly refund any payments already made.

 

§ 6 Payment Terms

(1) Payment can be made either in advance or via PayPal (direct debit and credit card payment is also possible for non-members). Invoicing will be done electronically; a paper invoice will not be sent.

 

(2) If you choose to pay in advance, we will provide you with our bank details in the order confirmation. The invoice amount must be transferred to our account within one week. The goods will be shipped immediately after receipt of payment.

 

(3) If you are in default of payment, the purchase price will be subject to interest at a rate of 5 percentage points above the base interest rate during the period of default. We reserve the right to prove and assert higher damages due to delay.

 

§ 7 Retention of Title

The goods remain our property until full payment has been made. Prior to transfer of ownership, pledging, transfer by way of security, processing, or modification is not permitted without our consent.

 

§ 8 Right of Withdrawal

(1) Consumers have a fourteen-day right of withdrawal. You can find the cancellation policy here.

 

(2) The right of withdrawal does not apply to the delivery of goods manufactured according to customer specifications or clearly tailored to personal needs, to the delivery of goods that are subject to rapid perishability and whose expiration date would be quickly exceeded, or to the delivery of sealed goods that are not suitable for return for health protection or hygiene reasons and whose seal was removed after delivery, as well as to the delivery of audio or video recordings or software, provided that the delivered data storage media have been unsealed by you.

 

(3) If you exercise your statutory right of withdrawal, you will be responsible for the return shipping costs.

 

(4) Please send an email to info@rominox.de before returning the goods to notify you of the return and include the invoice in the package. This will enable us to allocate the products as quickly as possible.

 

(5) Please note that the terms and conditions specified in paragraph (4) are not a prerequisite for the effective exercise of the right of withdrawal.

 

§ 9 Transport Damage

(1) If goods are delivered with obvious transport damage, please report such defects immediately to the deliverer and contact us as soon as possible (tel. +49 6541 818966-0).

 

(2) Failure to file a complaint or contact us will have no consequences for your statutory warranty rights. However, you will help us assert our own claims against the carrier or transport insurance.

 

§ 10 Warranty

The warranty is provided in accordance with the statutory provisions.

 

§ 11 Final Provisions

Should any provision of these General Terms and Conditions be invalid, the remainder of the contract shall remain valid. The relevant statutory provisions shall apply in place of the invalid provision.

 

Alternative dispute resolution pursuant to Art. 14 (1) ODR-VO and Section 36 VSBG:

The European Commission provides a platform for online dispute resolution (ODR), which you can find at http://ec.europa.eu/consumers/odr/. We are neither obligated nor willing to participate in dispute resolution proceedings before a consumer arbitration board.

How does the shopping cart system work?

You can reserve products without obligation by clicking the "Add to Cart" button. You can view your shopping cart at any time by clicking the shopping cart link in the top right corner of the website and, if necessary, delete products from the shopping cart by clicking the (X) button. If you would like to purchase the products in your shopping cart, click the "Checkout" button.

 

Do I have to register?

After selecting the products, you will be asked to enter your information. Mandatory information is marked with an *. You can optionally open a customer account and place future orders after entering your username and password, without having to enter your address details again.

 

When does my order become binding?

You can review your entries again on the order page. By clicking the "Order with payment" button, you submit a binding order. You can cancel the process at any time by closing the browser window. Further information, e.g., on correction options, is provided on the individual pages.

 

Is the contract text saved?

We save the contract text. The order details and the General Terms and Conditions will be sent to you by email. You can view past orders under "Your Account" if you have opened a customer account (guest orders cannot be viewed retrospectively for technical reasons).
